6. Payment Terms
6.1 Pricing and Charges
All prices displayed on our Website are in United States Dollars (USD) and are subject to change without notice. The price of an item at the time you place your order is the price you will be charged, subject to any applicable taxes, delivery fees, service fees, and other charges that will be disclosed prior to order confirmation.
6.2 Payment Methods
We accept various forms of payment as indicated on our Website at the time of checkout. By submitting a payment, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order, including applicable taxes and fees.
6.3 Order Confirmation
Once you submit an order, you will receive an order confirmation via email or on-screen notification. This confirmation does not constitute our acceptance of your order. We reserve the right to cancel or refuse any order at any time for reasons including, but not limited to, unavailability of items, suspected fraud, or errors in pricing or product information.
6.4 Refunds and Cancellations
Due to the perishable nature of our food products, all sales are generally final once an order has been prepared. If you have a concern about your order — including issues with quality, incorrect items, or missing items — please contact us at [email protected] within a reasonable time of receiving your order. We will evaluate your concern in good faith and may offer a replacement, credit, or refund at our sole discretion.
6.5 Taxes
You are responsible for all applicable federal, state, and local taxes associated with your purchase. Applicable taxes will be calculated and displayed at checkout.
7. Disclaimers
7.1 As-Is Basis
THE WEBSITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEQUOD'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7.2 No Warranty of Accuracy
We make reasonable efforts to ensure that the information on our Website is accurate and up to date. However, we do not warrant that the Website content, including menu descriptions, nutritional information, pricing, availability, or other details, is always accurate, complete, current, or error-free. Nutritional and allergen information is provided as a general guide only, and you should contact us directly if you have specific dietary requirements or allergen concerns.
7.3 Third-Party Services
Our Website may include links to or integrations with third-party websites, services, or platforms (such as payment processors or delivery partners). We do not control and are not responsible for the content, practices, or policies of any third-party services. Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.
7.4 Service Interruptions
We do not warrant that the Website will be uninterrupted, secure, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the Website at any time without notice or liability.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEQUOD'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF PEQUOD'S PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PEQUOD'S PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
THE LIMITATIONS OF LIABILITY SET FORTH HEREIN REFLECT A REASONABLE ALLOCATION OF RISK AND ARE A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND PEQUOD'S PIZZA. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pequod's Pizza and its officers, directors, shareholders, employees, agents, contractors, affiliates, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorney's fees and court costs) arising from or related to:
- Your access to or use of the Website or Services;
- Your violation of any provision of these Terms;
- Your violation of any third-party right, including intellectual property rights, privacy rights, or proprietary rights;
- Your violation of any applicable federal, state, or local law or regulation;
- Any content or information you submit, post, or transmit through the Website;
- Any fraudulent, negligent, or willful misconduct by you;
- Any claim or dispute arising out of your interaction with or orders placed through our delivery or service partners.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate fully with us in asserting any available defenses.
10. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them, including disputes about their formation, validity, effect, interpretation, breach, or termination, shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Pequod's Pizza operates, without regard to any conflict of law provisions.
To the extent that any dispute is not subject to mandatory arbitration as described below, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in the United States, and you waive any objection to the laying of venue of any such proceedings in such courts. The parties acknowledge that these Terms evidence a transaction involving interstate commerce, and the Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the arbitration provisions herein.
These Terms also comply with applicable provisions of the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive acts or practices in commerce, as well as any applicable state consumer protection statutes.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact Pequod's Pizza at [email protected] to attempt to resolve the dispute informally. We will use commercially reasonable efforts to resolve the dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved within thirty (30) days, either party may proceed with formal dispute resolution as described below.
11.2 Binding Arbitration
EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES, CONTROVERSIES, OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES, AS AMENDED FROM TIME TO TIME, WHICH ARE INCORPORATED HEREIN BY REFERENCE.
The arbitrator shall have the authority to award the same damages and relief as a court of competent jurisdiction, subject to the limitations set forth in these Terms. The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
11.3 Class Action Waiver
YOU AND PEQUOD'S PIZZA AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND PEQUOD'S PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
11.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
12. Term and Termination
12.1 Term
These Terms are effective from the date you first access or use the Website and shall remain in effect until terminated by either party as described herein.
12.2 Termination by User
You may terminate your account and cease using our Services at any time by contacting us at [email protected] with a written request. Termination of your account does not relieve you of any obligations incurred prior to termination, including outstanding payment obligations.
12.3 Termination by Company
We reserve the right, in our sole discretion, to suspend or terminate your access to all or any part of the Website and Services at any time, with or without notice and with or without cause, including but not limited to:
- Your breach or violation of any provision of these Terms;
- Suspected fraudulent, abusive, or illegal activity;
- Requests from law enforcement or government authorities;
- Unexpected technical or security issues;
- Extended periods of account inactivity;
- Discontinuation of our Services in whole or in part.
12.4 Effect of Termination
Upon termination of your account or your access to the Services, your right to use the Website and Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
13. Changes to Terms
Pequod's Pizza reserves the right to modify, update, or replace these Terms of Service at any time and at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or through a prominent notice on our Website.
Your continued access to or use of the Website and Services after any such changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must immediately cease using the Website and Services and, if applicable, terminate your account.
We encourage you to review these Terms periodically to stay informed of any updates. The most current version of these Terms will always be available at meals-pequods.click.
14. Privacy Policy
Your use of our Website and Services is also subject to our Privacy Policy, which is incorporated into and made a part of these Terms by reference. Our Privacy Policy describes how we collect, use, store, share, and protect your personal information in connection with your use of our Services. By using our Services, you consent to the data practices described in our Privacy Policy.

If you have food allergies, dietary restrictions, or specific nutritional requirements, we strongly encourage you to contact us directly at [email protected] before placing your order. Pequod's Pizza shall not be liable for any adverse reactions, health events, or damages arising from undisclosed allergens unless caused by our gross negligence or willful misconduct.
16. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or contrary to public policy for any reason, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be deemed severed from these Terms. The invalidity or unenforceability of any such provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall remain in full force and effect as if the invalid or unenforceable provision had never been included.
The parties agree that a court or arbitrator should endeavor to give effect to the parties' intentions as reflected in the provision to the greatest extent possible, even if the provision itself cannot be enforced as written.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by the Company on the Website, constitute the entire agreement between you and Pequod's Pizza with respect to your use of the Website and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the subject matter hereof.
No waiver by Pequod's Pizza of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure by the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. No amendment to these Terms will be effective unless made in writing and signed by an authorized representative of Pequod's Pizza, except for updates made pursuant to the "Changes to Terms" section above.
18. Force Majeure
Pequod's Pizza shall not be liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure is caused by events or circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, government actions, civil unrest, labor strikes, utility failures, internet outages, supply chain disruptions, or any other event constituting force majeure. In such circumstances, we will use commercially reasonable efforts to resume normal operations as soon as practicable.
19. Assignment
You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without our prior written consent. Any purported assignment in violation of this section shall be null and void.
